Terms of Service
Rules for FanScenes accounts, commerce, creator services, casting, collaboration, and production bookings.
Enovatek LLC d/b/a FanScenes.com ("FanScenes," "we," "us," or "our") operates FanScenes.com. These Terms of Service govern use of FanScenes accounts, subscriptions, purchases, creator and seller features, casting, collaboration, and FanScenes-arranged production bookings.
FanScenes is an adults-only service. By creating an account, purchasing or selling content, submitting an application, or using a production-booking feature, you confirm that you are at least 18 years old, legally permitted to use the service, and agree to these Terms and the policies incorporated into them.
FanScenes Service and Acceptance
FanScenes provides adult creator subscriptions, individual video sales, community and support features, creator and seller tools, casting workflows, and verified collaboration or production-booking features. Some services are offered directly by FanScenes and others facilitate interactions between independent users.
Additional creator, seller, casting, marketing, performer-release, production, payout, or other written agreements may apply to specific activities. If a specific written agreement conflicts with these general Terms for that activity, the more specific agreement controls to the extent of the conflict.
Accounts, Identity, and Eligibility
- You must provide accurate account and application information and keep required contact information reasonably current.
- You may not impersonate another person, use another person's identification, permit another person to complete verification in your place, or create an account to evade a restriction or suspension.
- Creator, seller, casting, and production participation may require identity and age verification, agreements, releases, tax or payout records, or additional review.
- FanScenes may deny, pause, restrict, or end access to features when reasonably necessary for safety, fraud prevention, legal compliance, payment risk, policy enforcement, or verification.
Purchases, Subscriptions, Tips, and Payments
Prices, billing intervals, applicable taxes, and other transaction details are shown at or before checkout. Recurring subscriptions renew according to the billing terms presented at purchase until cancelled or otherwise ended. Cancelling a recurring subscription normally stops future renewals and does not retroactively reverse access already provided, except where required by law or expressly approved by FanScenes.
Payment processing may be provided by third-party processors. Transactions may be declined, held, reversed, refunded, or reviewed for fraud, chargebacks, duplicate billing, technical errors, legal requirements, or other legitimate payment concerns.
Creator or Video Seller earnings, platform fees, payout timing, reserves, refunds, chargebacks, and tax requirements may be governed by separate creator or seller agreements and the transaction records shown inside FanScenes.
Collaboration and Production Bookings
A production request is only a proposal. It does not create a confirmed booking merely because it is submitted or accepted. A FanScenes Collaborate booking becomes confirmed only after the required FanScenes booking payment is successfully completed and the system marks the booking confirmed.
The booking page shows the agreed production amount, the FanScenes booking payment, and any amount due directly to the Creator or Video Seller at the shoot. The locked booking breakdown controls that booking even if FanScenes changes fee rates for future bookings.
After payment, FanScenes may release only the booking email, booking phone number, and contact preference that each participant expressly chose to share for confirmed-booking coordination. Participants may then coordinate the exact date, time, and location privately. Government identification, tax records, residential address, private verification files, and unrelated application contact information are not released as booking contacts.
The direct amount shown as due to the Creator or Video Seller at the shoot is paid directly between the participants unless FanScenes expressly states otherwise. FanScenes does not collect, hold, escrow, or guarantee that direct shoot balance.
Production compensation is for bona fide professional recorded-content participation, production time, and agreed content rights. It does not purchase personal or sexual access, does not waive consent, and does not override any participant's boundaries. Consent to any activity may be withheld or withdrawn as permitted by law, and recording or distribution requires the applicable separate releases and content authorization.
FanScenes Booking Payments, Cancellations, and Refund Review
The FanScenes booking payment covers the FanScenes booking service, including the confirmed booking workflow and release of the private booking contact information the participants elected to share. Once payment is completed and those private booking contacts are released, the FanScenes booking payment is generally non-refundable.
If the requester cancels after booking contacts have been released, the booking payment normally remains non-refundable. If the Creator or Video Seller cancels, the requester may qualify for FanScenes refund review because the cancellation may not have been caused by the requester. Duplicate charges, technical billing errors, or other exceptional circumstances may also be reviewed.
No cancellation report, accusation, or refund request automatically creates a refund. FanScenes may review the booking timeline, payment record, schedule, status updates, booking messages, optional check-ins, shoot-outcome records, participant responses, and other reasonably available evidence before deciding. A refund decision concerns the FanScenes booking payment only and does not determine or refund any direct shoot payment exchanged between participants.
Production Reliability and Three-Strike Rule
Cancellation, no-show, dishonest-status, or similar production reliability concerns may open an administrative review. An accusation alone is not a strike. FanScenes Admin reviews the available evidence and separately decides whether a Production Reliability strike is appropriate.
One active strike is a warning. Two active strikes are a final warning. Three active Production Reliability strikes suspend the person's ability to start or accept new FanScenes production or casting bookings while the suspension remains active. Existing booking, casting, and review records may remain available for administration, evidence, or appeal.
FanScenes Admin may close a review without a strike, issue a strike after review, or overturn a prior strike when new information or an administrative correction justifies doing so. When the active strike count falls below three, production and casting eligibility may be restored.
Booking Records, Reminders, and Dispute Evidence
FanScenes may send transactional booking reminders, schedule-confirmation requests, approaching-shoot reminders, post-shoot follow-ups, cancellation notices, reliability notices, or administrative-review messages to help participants and FanScenes manage a confirmed production.
Participants are not required to conduct every production conversation through FanScenes after booking contacts are released. However, if plans change or a dispute occurs, timely use of FanScenes status updates, booking messages, cancellation reports, optional check-ins, and shoot-outcome tools may create evidence that can be considered during refund, no-show, cancellation, safety, or Production Reliability review.
FanScenes may be unable to grant a requested refund or make a requested reliability finding when the available evidence is insufficient or conflicting.
Content, Consent, and Prohibited Conduct
Users may upload, publish, purchase, sell, or participate in content only when they have the rights, permissions, releases, and lawful authority required for that activity. Content involving minors, non-consensual conduct, exploitation, impersonation, fraud, unlawful material, or other prohibited activity is not allowed.
Users may not use FanScenes to harass, threaten, stalk, defraud, exploit, coerce, dox, circumvent verification, manipulate disputes, submit knowingly false reports, or interfere with the safety or lawful rights of another person. FanScenes may preserve relevant records and restrict features while reviewing suspected abuse.
Independent Participants and No Guarantee of a Shoot
Creators, Video Sellers, casting participants, and requesters may be independent users rather than employees or agents of FanScenes. FanScenes can provide verification, platform tools, payment processing for the FanScenes booking payment, reminders, and administrative review, but does not guarantee that a particular production will occur, that participants will agree on every final detail, or that a participant will perform obligations outside the FanScenes-controlled portion of the service.
Suspension, Termination, and Enforcement
FanScenes may restrict or terminate accounts or specific features when reasonably necessary to enforce these Terms, another applicable agreement, payment obligations, age or identity requirements, content rules, Production Reliability decisions, safety standards, or law. Account deletion does not erase transaction, verification, consent, tax, dispute, copyright, safety, or other records that FanScenes is permitted or required to retain.
Service Availability and Limitation of Responsibility
FanScenes works to provide a secure and reliable service, but websites, payment processors, hosting providers, internet connections, third-party integrations, and user-controlled devices can experience interruptions or errors. To the extent permitted by applicable law, FanScenes does not promise uninterrupted availability and is not responsible for conduct or direct arrangements between independent participants that occur outside FanScenes' control.
Nothing in these Terms excludes or limits rights or responsibilities that cannot lawfully be excluded or limited.
Changes to the Service or Terms
FanScenes may update these Terms as the service, booking workflows, payment practices, safety requirements, or law change. The Last Updated date identifies the current version. Material changes may also be communicated through the site or account contact information when appropriate. Continued use after an updated version becomes effective constitutes acceptance to the extent permitted by law.
Governing Law and Severability
Subject to mandatory law that may apply, these Terms are intended to be governed by the laws of the State of California, without regard to conflict-of-law principles. If a provision is found unenforceable, the remaining provisions remain in effect to the extent permitted by law.
Contact
These Terms are an operational policy for FanScenes and should be reviewed periodically as the service changes. Nothing on this page is intended to waive rights that cannot lawfully be waived.
