Designated DMCA Agent

DMCA notices and counter-notices should be sent to the designated agent. Email is preferred for faster processing. Include "DMCA Notice" or "DMCA Counter-Notice" in the subject line.

How to Submit a DMCA Takedown Notice

A written notice should include substantially all of the following:

1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
2. Identification of the copyrighted work claimed to have been infringed. A representative list may be used when multiple works at one online location are covered.
3. Identification of the material claimed to be infringing, together with the specific FanScenes URL or other information reasonably sufficient for us to locate it.
4. Contact information reasonably sufficient for us to reach the complaining party, including name, mailing address, phone number, and email address.
5. A statement that the complaining party has a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right allegedly infringed.

When appropriate, FanScenes may remove or disable access to identified material, preserve relevant records, notify the uploader, and take other action permitted by law or our policies.

Counter-Notice

A person whose content was removed or disabled because of a DMCA notice may submit a written counter-notice containing substantially all of the following:

1. The subscriber's physical or electronic signature.
2. Identification of the material removed or disabled and the location where it appeared before removal or disabling.
3. A statement under penalty of perjury that the subscriber has a good-faith belief the material was removed or disabled because of mistake or misidentification.
4. The subscriber's name, address, and phone number, together with consent to the jurisdiction of the appropriate United States federal district court and acceptance of service of process from the person who submitted the original notice or that person's agent.

After receiving a valid counter-notice, FanScenes may provide it to the original claimant and may restore the material after the period permitted by law unless the designated agent receives notice that the claimant filed a court action seeking to restrain the alleged infringement.

Repeat Infringers and Other Action

FanScenes may suspend or terminate accounts of repeat infringers in appropriate circumstances. We may also restrict uploads, preserve evidence, remove content under other policies, or take action when material creates safety, consent, impersonation, privacy, or legal concerns even when a submission does not satisfy every DMCA requirement.

Misrepresentation and Abuse

Submitting a knowingly false or materially misleading notice or counter-notice may result in liability, including damages, costs, and attorneys' fees. DMCA procedures should not be used to resolve privacy, harassment, contract, trademark, impersonation, or content-consent disputes unless the claimant is asserting a valid copyright interest.

Other Content Complaints

For reports involving consent, minors, impersonation, privacy, harassment, illegal content, or immediate safety concerns, contact legal@fanscenes.com and clearly identify the affected URL and concern. Do not send government identification through ordinary email unless FanScenes specifically requests it through an approved secure process.
