1. Parties and Purpose
This Female Casting Participation Agreement (the “Agreement”) is between Enovatek LLC, doing business as FanScenes.com (“FanScenes”), and the person identified in the related Female Casting Application (“Applicant”). The purpose of this Agreement is to establish preliminary requirements for the Applicant to be considered for professionally administered FanScenes productions.
2. Application Only; No Confirmed Shoot
The Applicant understands that submitting an application, completing identity verification, or signing this Agreement does not guarantee approval, employment, compensation, a particular creator, a production date, or participation in any shoot. A shoot is not approved or scheduled unless FanScenes provides separate final written confirmation.
3. Age, Identity, and Accurate Information
The Applicant represents that the Applicant is at least eighteen (18) years old, has provided the Applicant’s true legal name and correct date of birth, and has submitted authentic identification belonging to the Applicant. The Applicant will not allow any other person to apply, verify, sign, or participate using the Applicant’s identity. FanScenes may request additional lawful verification before approving participation.
4. Voluntary Participation, Consent, and Boundaries
Participation is voluntary. The Applicant may decline any proposed concept or activity and may communicate or revise boundaries before an approved production. Agreement to discuss or participate in one activity does not constitute agreement to any other activity. Every activity requires separate, informed, and ongoing consent from every participant. No person may threaten, pressure, coerce, or retaliate against the Applicant for declining or stopping an activity.
5. Professional Administration and No Private Arrangements
All screening, production discussions, creator coordination, pricing or compensation discussions, and scheduling must be managed or expressly approved by FanScenes administration. The Applicant will not use the casting process to arrange unauthorized private meetings with fans, subscribers, creators, or other participants. Private contact information must not be shared for the purpose of avoiding FanScenes administration or arranging an unauthorized meeting.
6. Compensation, Travel, and Expenses
No compensation, travel reimbursement, lodging, or expense payment is promised by this Agreement. Any compensation and approved expenses must be stated in a separate written production confirmation or agreement before the Applicant incurs an expense or participates in a shoot.
7. Safety, Fitness to Participate, and Professional Conduct
The Applicant agrees to follow reasonable production, studio, consent, and safety rules communicated before an approved shoot. The Applicant will not participate while impaired by alcohol, illegal drugs, or any condition that prevents informed consent or safe participation. The Applicant will promptly raise any safety, consent, accessibility, or boundary concern with FanScenes administration. All participants are expected to behave professionally and respectfully.
8. Privacy and Confidential Information
The Applicant will not improperly disclose private verification records, unpublished production concepts, private communications, personal information, or confidential business information received through the casting process. This provision does not prohibit the Applicant from reporting suspected unlawful conduct, seeking medical care, consulting an attorney, cooperating with authorities, or exercising any right protected by law.
9. Identity Records and Required Documentation
The Applicant authorizes FanScenes to review and securely retain identity, age, agreement, and participation records to the extent reasonably necessary for casting review, safety, fraud prevention, legal compliance, and production recordkeeping. Identification documents are not intended for the Applicant’s public profile, public feed, or WordPress Media Library.
10. Separate Production Consent, Release, and Content Authorization
This Agreement does not authorize FanScenes or any other person to record, publish, sell, license, distribute, advertise, or otherwise use the Applicant’s image, likeness, voice, performance, or recorded content. Every approved production requires separate shoot-specific consent, boundaries, compensation terms when applicable, performer releases, content authorization, and any records required by applicable law.
11. Electronic Records and Signature
The Applicant agrees to receive and review this Agreement electronically and to use the Applicant’s typed full legal name as an electronic signature. The Applicant understands that FanScenes will record the agreement version, signature, application number, date and time, account or email information, IP address, browser or device information, required acknowledgments, and a digital hash of the agreement text.
12. Final Review, Withdrawal, and Cancellation
FanScenes may approve, decline, pause, or cancel an application or proposed production based on eligibility, verification, safety, availability, legal requirements, production needs, or other legitimate business considerations. The Applicant may withdraw from consideration before entering a separate binding production commitment, subject to any obligations already accepted in another written agreement.
13. Governing Law and Complete Preliminary Agreement
Subject to any mandatory law that applies, this Agreement is intended to be governed by the laws of the State of California. This Agreement contains the complete preliminary casting-participation understanding between FanScenes and the Applicant concerning the subjects addressed here and may be changed only in a later written agreement accepted by the applicable parties.
Applicant acknowledgment: By completing the required confirmations and typing the Applicant’s full legal name, the Applicant confirms that the Applicant has read this complete Agreement, understands it, has had the opportunity to ask questions or seek independent advice, and agrees to its terms.
